ILLINOIS DOG BITE LAW

The law in Illinois very clearly states that the owner of a dog is fully responsible and liable for all injuries and damages to the victim who was bitten by his or her dog. Illinois is what is referred to as a "strict liability state" as is evident in its laws.

Illinois law relating to dog/animal bites (510 ILCS 5/16 Section 16) states:

"If a dog or other animal, without provocation, attacks attempts to attack or injured any person who is peaceably conducting himself or herself in a place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby."

WHAT THE PLAINTIFF MUST PROVE

Under Illinois law, a Chicago dog attack attorney for the plaintiff must establish the following in order to prove his or her client's case and get compensation/damages:

  • The identity of the dog and its owner
  • That the dog attack happened and that the particular dog attacked and bit the victim
  • It was the dog bit that caused the injuries, pain and suffering
  • That the attack occurred in a public place or in a place where the victim had the right or permission to be at the time of the incident

The law also clearly states that there are certain circumstances under which the owner is not liable. This could be true if the victim was trespassing or knowingly provoked the animal or was committing a crime such as a break-in or burglary at the time of the attack.

Illinois law also provides that the victim may receive money for medical treatment involving first aid, emergency room procedures as well as emergency transport; future treatment such as cosmetic surgery to reduce or erase bite scars; counseling to deal with psychological issues such as paranoia, emotional distress and dealing with injuries and scars; and loss of wages.
